Following the Australian government’s decision to phase out the innovation patent system, the final day on which an innovation patent can be filed is 25 August 2021.
Any innovation patent application filed up to and including this date will enjoy the same rights and term of up to 8 years as any other innovation patent. After this date, however, patent applicants will only have the option of filing a standard patent application for their invention.
